Please read these Terms of Service ("Terms") carefully before using the Restauranti platform operated by Tingo Brand SAS ("Company", "we", "us", or "our"). By accessing or using our service, you agree to be bound by these Terms. If you disagree with any part, you may not access the service.

1. Description of Service

Restauranti is an AI-powered marketing platform designed for restaurants. Our service includes AI-generated marketing campaigns, social media content, food photography, smart scheduling, and analytics tools. We reserve the right to modify or discontinue the service at any time with reasonable notice.

2. Account Registration

To access most features, you must create an account. You agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use. We may terminate accounts that violate these Terms.

3. Acceptable Use

You agree not to use the service to:

• Generate, distribute, or promote content that is illegal, harmful, defamatory, or misleading.
• Infringe on any intellectual property rights of third parties.
• Attempt to reverse-engineer, hack, or disrupt the platform or its underlying systems.
• Use automated tools to scrape, crawl, or extract data beyond normal usage.
• Resell or sublicense access to the platform without our written consent.
• Violate any applicable local, national, or international laws.

4. Subscription and Payment

Restauranti offers subscription-based plans billed monthly. By subscribing, you authorize us to charge your payment method on a recurring basis. All fees are:

• Non-refundable unless required by applicable law or explicitly stated in a refund policy.
• Subject to change with 30 days' notice before the next billing cycle.
• Exclusive of taxes, which may be added based on your jurisdiction.

Failure to pay may result in suspension or termination of your account. AI credit balances expire at the end of each billing period and are non-transferable.

5. Free Trial

New accounts may be eligible for a free trial period as described on our pricing page. At the end of the trial, your account will be automatically converted to a paid plan unless cancelled before the trial expires. We reserve the right to modify or end free trial offers at any time.

6. Intellectual Property

Our platform: The Restauranti platform, including its code, design, logos, and branding, is owned by Tingo Brand SAS and protected by intellectual property laws.

Your content: You retain ownership of the business information and materials you upload. By using the service, you grant us a limited license to use your content solely to provide the service. AI-generated content produced using your inputs is yours to use, subject to the terms of the underlying AI providers.

7. AI-Generated Content Disclaimer

Content generated by our AI tools is provided as-is for marketing purposes. You are solely responsible for reviewing, editing, and ensuring the accuracy, legality, and appropriateness of all content before publishing. Restauranti is not liable for any consequences arising from AI-generated content you choose to publish.

8. Termination

You may cancel your subscription at any time from your account settings. We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or for any other reason at our discretion. Upon termination, your right to use the service ceases immediately and we may delete your data in accordance with our Privacy Policy.

9. Limitation of Liability

To the maximum extent permitted by law, Restauranti and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or goodwill, arising from your use of or inability to use the service. Our total liability for any claim related to the service shall not exceed the amount you paid us in the three months preceding the claim.

10. Disclaimer of Warranties

The service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the service will be uninterrupted, error-free, or that AI-generated content will meet your expectations.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Colombia, without regard to its conflict of law provisions. Any disputes shall be resolved through binding arbitration or in the competent courts of Bogotá, Colombia.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or in-app notice at least 14 days before they take effect. Continued use of the service after changes constitutes acceptance of the revised Terms.
